Randall Mroczynski is a partner in Cooksey’s Creditors’ Rights and Bankruptcy group. Since 1991, Mr. Mroczynski has represented secured and unsecured creditors throughout twenty-five states in cases filed under all Chapters of the United States Bankruptcy Code. Mr. Mroczynski has prosecuted and defended thousands of bankruptcy adversary proceedings and contested matters. Mr. Mroczynski also chairs Cooksey’s bankruptcy and commercial law appellate group and has briefed and argued appellate matters to the 9th Circuit Court of appeals, the 9th Circuit Bankruptcy Appellate Panel, the 8th Circuit Court of Appeals, the 8th Circuit Bankruptcy Appellate Panel, the 10th Circuit Bankruptcy Appellate Panel and appellate divisions in the state of California. Mr. Mroczynski served as lead appellate counsel in the case of In re Dumont, 581 F.3d 1104 (9th Cir. 2009) which was the first Circuit level decision interpreting the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 to have eliminated the “pay and drive” option for secured motor vehicle collateral.
Through his practice, Mr. Mroczynski has developed specialties in representing clients throughout the Western United States in the trucking and transport, automotive, and real and personal property financing industries. Mr. Mroczynski has represented a myriad of clients, from large multinational corporations to individuals.
